Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Pool Sage (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including free trial users and paying subscribers.

2. Informational Purposes Only

Pool Sage and its AI assistant AL GEE provide general pool care guidance for informational and educational purposes only. The content, suggestions, chemical recommendations, maintenance plans, and recovery guides provided through the Service are not a substitute for professional advice from a licensed pool technician, water treatment specialist, or other qualified professional.

Pool conditions vary significantly based on factors including but not limited to water source chemistry, local climate, pool construction materials, equipment type and age, bather load, and surrounding environment. Recommendations that are appropriate for one pool may be inappropriate or harmful for another. You are solely responsible for evaluating whether any guidance provided by Pool Sage is appropriate for your specific situation before acting on it.

3. Assumption of Risk

Pool maintenance involves inherent risks, including exposure to hazardous chemicals, equipment malfunctions, and water safety hazards. By using the Service, you acknowledge and accept these risks. You agree to:

• Always read and follow all chemical manufacturer instructions, safety data sheets, and warning labels.
• Wear appropriate protective equipment when handling pool chemicals.
• Store and dispose of chemicals in accordance with applicable laws and manufacturer guidelines.
• Never mix pool chemicals unless explicitly directed by the manufacturer.
• Use your own judgment and consult a qualified professional when in doubt.

Pool Sage does not assume any responsibility for personal injury, property damage, equipment damage, or any other harm resulting from your use of or reliance on the Service.

4. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. POOL SAGE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT OR RECOMMENDATIONS PROVIDED THROUGH THE SERVICE ARE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR POOL.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POOL SAGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Damage to your pool, pool equipment, or surrounding property;
• Personal injury or illness arising from chemical use or pool conditions;
• Financial loss resulting from pool repairs, chemical purchases, or professional service calls;
• Any damages arising from reliance on AL GEE's recommendations or guidance.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO POOL SAGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

6. Indemnification

You agree to indemnify, defend, and hold harmless Pool Sage and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of or reliance on the Service; (b) your violation of these Terms; (c) any action you take based on recommendations provided by AL GEE or any other part of the Service; or (d) any harm caused to a third party as a result of your pool maintenance activities.

7. Subscriptions and Billing

Pool Sage offers monthly ($9.99/month) and annual ($89.99/year) subscriptions, each including a 14-day free trial. After the trial period ends, your chosen plan will be billed automatically using your payment method on file. You may cancel at any time from within the app.

8. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and you will retain access through that date. We do not offer partial refunds for unused subscription time. Contact info@poolsage.app for billing questions.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of Pool Sage after the effective date of any changes constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.
